Tenants who do not comply with the terms of the tenancy agreement, including the absence of monthly rent, cannot be forcibly evicted by their landlord. The same applies to tenants who, beyond the agreed duration, remain in the occupancy of their building. There are two rates for utilities The “domestic” electricity rate is much higher than the “residential rate.” Maltese residents are entitled to a lower and cheaper “residential rate” if utility companies are changed for their name when renting a property. Make sure that the way electricity bills are paid is set when the lease is signed. When renting a property, there is little paperwork to add. Once a property has been found, the tenant is required to sign a rental agreement that is usually provided by the real estate agent. This agreement lists the rights and obligations of tenants and landlords/owners. For each new private rental agreement, a separate registration is required. The new rental rules make it punishable for an owner to forcibly evict the tenant of a property he occupies as his principal residence.
This applies only to private rental contracts, not room rentals. The rent can only be increased if the tenancy agreement is expressly provided and, if so, it can only be increased once a year. Short contracts must identify the above categories used and provide supporting documentation. Otherwise, the contract would be considered a private lease for at least one year. The notice period should be set in the lease agreement. Landlords and tenants are able to freely negotiate the termination of a contract. If one of the parties violates one of the terms of the lease, the contract may be terminated. A deposit must be paid to the owner to insure the damages during the duration of the rental. This is usually one month`s rent. It should be returned to the outgoing tenant at the end of the tenancy agreement or used in part to repair the invoices or, if necessary, to repair the damage. In the event of a short-circuit, the tenant can terminate his tenancy agreement at the end of one month without loss of deposit, provided that the landlord is notified by recommended letter one week in advance.
The lease expires at the expiry of the mark, as long as the landlord calls the tenant with a recommended letter for at least three months.
